THIS IS A BINDING LEGAL AGREEMENT BETWEEN POLPICS.COM AND YOU,
OR, IF YOU MAKE THIS AGREEMENT ON BEHALF OF YOUR EMPLOYER, THE SAME RIGHTS, LIMITATIONS AND RESTRICTIONS APPLY TO YOUR EMPLOYER.
PLEASE READ THIS LICENSE AGREEMENT CAREFULLY BEFORE DOWNLOADING PICTURE.
BY DOWNLOADING PICTURE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS LICENSE AGREEMENT.

CAPTIONS - Although we do our best to keep the facts given in captions updated and accurate, we take no responsibility for its correctness.
An image may not be incorporated into a derivative artwork for which a claim of new copyright may be obtained.
An image may not be incorporated in a product for the purpose of redistributing, sublicensing or re-selling the image, and the images themselves may not be sold or rented.

STORAGE - Unless otherwise agreed with Polpics.com, in the event photographs are stored digitally for the technical production purposes, such shall be discarded once production is completed.
A stored photograph must not be reused without prior permission from Polpics.com.
Polpics.coms' photographs must not be downloaded or copied onto a database, CD-ROM or suchlike, and must not be made available in a local, regional, or an international network (i.e. the Internet) without special agreement in each individual case. In such cases, they must at all times be affixed with an annotation stating that the photograph is protected under copyright laws.

PAYMENT - Payment is made through invoice payable within 20 days from time of purchase.

CANCELLATION - After special agreement, it is possible to cancel the right to use an image after purchase has been made. Cancellation fee plus service costs will be charged accordingly.
If you cancel rights stated in the invoice within ten (10) business days from the date of the invoice, you will be charged a 50 Euro fee per image. If the cancellation notice is received more than ten (10) but less than thirty (30) business days after the invoice date, a cancellation fee equal to fifty (50%) percent of the amount of the Invoice will be charged. In any case, the minimum cancellation fee is 50 Euro per image. After thirty days, no cancellations will be accepted and the full amount of the invoice must be paid. For any cancellations, you must pay the full service costs.

BYLINE - When a photograph is reproduced, a byline "Photo: Polpics.com" or “© Polpics.com” shall always be displayed. Failing to state this byline will result in a subsequent charge amount to 50% of the original cost of licensing.

Polpics disclaims responsibility for any irregularities in the service provided.

ONLINE, IMAGES MAY BE LICENSED FOR USE IN EDITORIAL PUBLICATIONS, where the image directly relates to editorial content and does not libel, defame or invade privacy. You must contact us to discuss promotional, advertising, merchandising or commercial uses. Prices for such use can be found in the downloadable pricelist under the link "Prices".

According to law, you may not use a photograph of any recognizable living person in advertising without permission from that person. Anyone using the photograph for such purposes shall be responsible for obtaining such permission and for paying a reasonable modeling fee. For certain pictures a Permission/Model release can be obtained and administrated by Polpics.com. This service will be charged separately.
Polpics.com disclaims all liability in cases where customers use photographs for advertising purposes without the permission of the person depicted therein.
A photograph of a recognizable person may also constitute personal information and may thus require permission from that person in order to be exposed on the Internet.

SENSITIVE SUBJECTS - You may not use an image that depicts or identifies a real person in connection with sensitive subject matter (e.g., sex, abortion, birth control, physical and mental ailments, or drugs), nor that conveys or implies endorsement of a product or service, without prior written permission from Polpics.com.
Pornographic, defamatory, or libelous use of the images is prohibited. If an image depicts or identifies a real person, a fictional character, a trademark, or any other legally protected property, you must consult your legal counsel to insure that your intended use of the image is not contrary to the rights of publicity and privacy or any other legal right of any person or entity concerned.

As a customer, you bear sole responsibility for complying with these rules in conjunction with the use of photographs you order from Polpics.com. So, please check closely.
